and second DUI convictions within a period of five years
are classified as misdemeanors. However, a third DUI
conviction is a felony if it occurs within five years
of being convicted for a first offense DUI.
First time convicts face fines of up to $1000, two
days in jail (or at a DUI Victims Impact Panel), attendance
in an alcohol safety and education program, and driver’s
license suspension for 90 days to one year. Penalties
increase with a second offense and may include up to
a year in jail. Third offenses are felonies and require
one to five years in the State Penitentiary, vehicle
seizure, five year license suspension, and fines of
up to $5000.
