DUI
If you have recently been charged with driving under the influence, you’re probably confused and worried: Will I be able to drive to work? Will my automobile insurance increase? Will I go to jail? What steps should I take to protect my legal rights? Being arrested for a DUI is serious. In the state of Mississippi, first and second DUI convictions within a period of five years are classified as misdemeanors. However, a third DUI conviction is a felony if it occurs within five years of being convicted for a first offense DUI.

First time convicts face fines of up to $1000, two days in jail (or at a DUI Victims Impact Panel), attendance in an alcohol safety and education program, and driver’s license suspension for 90 days to one year. Penalties increase with a second offense and may include up to a year in jail. Third offenses are felonies and require one to five years in the State Penitentiary, vehicle seizure, five year license suspension, and fines of up to $5000.
